President Barack Obama instructed Justice Department attorneys to argue last week in San Francisco before Federal District Judge Vaughn Walker, that he must toss out the Electronic Frontier Foundation's Shubert v. Bush lawsuit challenging the secret state's driftnet surveillance of Americans' electronic communications.

In a Court filing late Friday night, the Obama Administration attempted to dress up in new clothes its embrace of one of the worst Bush Administration positions--that courts cannot be allowed to review the National Security Agency's massive, well-documented program of warrantless surveillance. In doing so it demonstrated that it will not willingly set limits on its own power and reinforced the need for Congress to step in and reform the so-called 'state secrets' privilege.

In Battle Over Gay Marriage, Timing May Be Key

In a San Francisco courtroom two weeks ago, a prominent lawyer opposed to same-sex marriage made a concession that could mark a turning point in the legal wars over the purpose and meaning of marriage.

The lawyer, Charles J. Cooper, has studied the matter deeply, and his erudite briefs are steeped in history. He cannot have been blindsided by the question Judge Vaughn R. Walker asked him: What would be the harm of permitting gay men and lesbians to marry?

“Your honor, my answer is: I don’t know,” Mr. Cooper said. “I don’t know.”

A couple of hours later, Judge Walker denied Mr. Cooper’s motion to dismiss a lawsuit seeking to establish a constitutional right to same-sex marriage. The concession and the ruling that followed it have transformed a federal lawsuit that had been viewed with suspicion by many gay rights advocates into something with the scent of promise.

Forget About Gay Marriage...Apparently, We Still Haven't Settled Inter-racial Marriage

clipper's remarks: On the marriage front, the actions of the judiciary this past week were a mixed bag. In San Francisco, U.S. Dist. Judge Vaughn Walker refused to dismiss a challenge by marriage rights proponents to California's Prop 8, which limits marriage in the state to a union between a man and a woman.

This came as welcome news to California's marriage law proponents whose state law challenges to Prop. 8 proved unsuccessful before the California Supreme Court.

Ironically, on the very page where this story was reported online, a link appeared, stating that an interracial couple was denied a marriage license in LA. Both articles are worth reading, but the article about the LA case contains quotes by the judge who denied the marriage license.

These quotes are shocking in their narrow-mindedness and reek of the same bigotry that the U.S. Supreme Court supposedly put to rest when it outlawed bans against interracial marriage in Loving v. Virginia.

Interracial couple denied marriage license in La.

A white Louisiana justice of the peace said he refused to issue a marriage license to an interracial couple out of concern for any children the couple might have.

Keith Bardwell, justice of the peace in Tangipahoa Parish, says it is his experience that most interracial marriages do not last long.

"I'm not a racist. I just don't believe in mixing the races that way," Bardwell told the Associated Press on Thursday. "I have piles and piles of black friends. They come to my home, I marry them, they use my bathroom. I treat them just like everyone else."

Reporting from San Francisco - A federal judge refused Wednesday to dismiss a constitutional challenge to Proposition 8, ruling that a trial was required to resolve legal and factual disputes over the voter-approved ban on same-sex marriage.

U.S. District Judge Vaughn R. Walker, ruling after nearly two hours of argument in San Francisco, rejected arguments by Proposition 8 proponents that precedent and tradition clearly showed last November's ballot measure was permissible under the U.S. Constitution.

During the hearing, Charles Cooper, representing the Proposition 8 campaign, argued that marriage historically has been reserved for unions between a man and a woman because only opposite-sex couples can procreate "naturally."

Walker, however, noted that not all married couples can procreate.

"Just last month," Walker said, "I performed a wedding in which the groom was 95 and the bride was 83. I did not demand that they prove they would engage in procreation."

There's something inherently funny about a man in therapy. I realized this recently when I saw the trailer to Couples Retreat , a new Vince Vaughn comedy hitting theatres today. Three of the four couples in the film that attend said retreat are led to believe it's just an economical group-rate vacation, but then are bullied into also partaking in the couples counselling aspect of the tropical getaway. Humour ensues! And many of the jokes, it appears, have to do with this stigma of men talking out their relationship issues with a shrink.

“One thing that a lot of the research has shown is that men who are especially attached to classic notions of masculinity – don't be vulnerable, don't appear weak, be in control – are more likely to be experiencing depression and are more likely to be unhappy in their relationship,” he says. “And those men are also the ones least likely to seek out the relatively proven methods we've got for ameliorating those situations. That's a bad combination.”

Daily, 44, of Newberg, was accused of rape, sodomy and other sex-related crimes, including posting Craigslist ads to solicit others to join in group sex with a 14-year-old girl, authorities said. There also were allegations of adults showing up to have sex with the teen, as well as police seizing drugs, sex toys and computer images of victims.

Sherry Donaldson, who lives in rented quarters adjoining Daily's, said she's glad that after she smelled the odor of marijuana seeping into her kitchen she told her children to stay within the fenced yard in front, and not go to the back where he lived with two young daughters and a small dog named Buddy.

A federal judge has ordered sponsors of California's Proposition 8 to release campaign strategy documents that opponents believe could show that backers of the same-sex marriage ban were motivated by prejudice against gays.

Plaintiffs in a federal suit seeking to overturn Prop. 8

contend that the measure's real purpose was to strip a historically persecuted minority group of rights held by the majority.

If the courts find that the ballot measure was motivated by discrimination, they could strike it down without having to decide whether gays and lesbians have a constitutional right to marry.

"The intent or purpose of Prop. 8 is central to this litigation," Chief U.S. District Judge Vaughn Walker declared

In previous rulings, Walker has said the constitutionality of Prop. 8 is not an open-and-shut legal question but could depend on a variety of factors, including whether backers were biased against gays and lesbians.
