EUOBSERVER / BRUSSELS - Hailed as the EU's first real step towards direct democracy, a right contained in the new Lisbon Treaty allowing EU citizens to ask the European Commission to initiate a law is shaping up to be a political and legal minefield.

The wording of the 'citizens initiative' article requires one million signatures from EU citizens for the commission to consider a legislative proposal, but its implementation throws up practical problems.

The commission proposes giving itself wiggle room for repeated petitions on issues it does not want to follow up, noting that "disincentives or time limits" could prevent "successive presentations of the same request."

EU communications commissioner Margot Wallstrom has in the past predicted the tool will be "used immediately" by citizens, noting that it will be "the better if it causes some problems for the commission" as it will bring the institution more into contact with ordinary people and what they are looking for from the EU.

The NATO mission in Afghanistan has been shaken by the news that two Czech officers were found wearing Nazi insignia. The symbols of SS battalions on their helmets has resulted in the two men being suspended. Their commanding officer has also been suspended amid reports that he'd ordered a cover-up. The two soldiers recently returned from Afghanistan and received state awards.

The Anti-Counterfeiting Trade Agreement (ACTA) is an attempt to update international law to deal with online intellectual-property violations. The negotiations concluded on Friday and the next round are scheduled for Mexico in January.

One of the proposals, according to leaks, involve a three-strikes system: three infringements and your Internet service provider (ISP) has to yank the cord from the IP address, not just the lone user. A few illegal downloads, iPhone hackings or movie uploads and an entire family could be without Internet for 12 months.

Some of that paperwork was finalized at this table in Querétaro. Under the treaty, in exchange for about $18 million, Mexico gave up 525,000 square miles of territory, including California and Texas. In many ways, that land transfer at gunpoint is the move that made the U.S. the power it is today, leaving many Mexicans with a bitter taste.

After a simple recall mémoriel in 1959, it is in 1985 that the first identity demonstration was organized, attracting from now on several thousands of people, in presence, this year, of the direction of the political party souverainist ERC (left republican of Catalonia), established in Barcelona. Ten organizing associations, in a Catalan vision of the History, asserts a feeling of "resistance", but on the other hand, in a French vision, the city council man perpignanais MRC (Republican Movement and Citizen) Olivier Amiel, considers that the term "annexation" of Roussillon in France, usual in Catalonia, goes to "misinterpretation of the history".

On November 7, 1659, was signed in the Island of Pheasants on the Bidasoa, the Pyrenean treaty that ended 24 years of war with France.

A Senate climate change panel gives a feel-good nod to the collapsing Copenhagen process:

Last night the Conservative MEP Daniel Hannan resigned as European legal spokesman and returned to the back benches in protest at his party's position on the Lisbon Treaty. Today a second Tory MEP, Roger Helmer, also quit the front bench in protest at his party's 'confused' Lisbon Treaty U-turn. He has resigned as employment spokesman because, he said, he could neither 'justify nor support' the Conservatives' new policy.

Right, so that means one can count the Tory politicians with principles not so much on one hand as on two thumbs. But just in case Hannan and Helmer are worried their lonely protest will mean nothing, I give them this picture. Think on.

The internet chapter of the Anti-Counterfeiting Trade Agreement, a secret copyright treaty whose text Obama's administration refused to disclose due to "national security" concerns, has leaked. It's bad. It says:

* * That ISPs have to cut off the Internet access of accused copyright infringers or face liability. This means that your entire family could be denied to the internet -- and hence to civic participation, health information, education, communications, and their means of earning a living -- if one member is accused of copyright infringement, without access to a trial or counsel.

* * That the whole world must adopt US-style "notice-and-takedown" rules that require ISPs to remove any material that is accused -- again, without evidence or trial -- of infringing copyright. This has proved a disaster in the US and other countries, where it provides an easy means of censoring material, just by accusing it of infringing copyright.
