On Monday, the Supreme Court will explore what type of inventions would require a patent in a pivotal case that can undermine a legal protection for software. This patent rule will bar processes and methods in doing businesses. Among those are online shopping techniques, medical diagnostic tests, procedures for executing trades on Wall Street and even undercut patents on software formulation and manufacture. The bad side of this ruling might affect high-tech industries as it can invalidate many existing software patents or at it maybe difficult for them to defend their case in lawsuits. It can also hard to apply for patents since softwares are generally patented as a process for doing something than as a physical invention.

As Rupert Murdoch talks about how he wants to cut off Google, while claiming that aggregator sites are "parasites" and "stealing" from him -- and that fair use would likely be barred by the courts, it seemed like a good time to examine at least some of the sites that are owned by Rupert Murdoch that appear to aggregate content from other sites and which rely on the very same fair use argument.

Are You Nice or Am I Famous?

I had an interesting exchange on Twitter the other day.

Me: During my CA round-trip, American did 3 nice things (ex: free rebook for missed flight). Did I get lucky 3 times, or is AA always like this?

Skyvan: They know who you are, that’s why you got that treatment. They never do that.

Dandebrito: American: “Hmmm… Pogue has over a million Twitter followers. Should we be extra nice or give him steerage service?”

What my readers are suggesting, of course, is that I’m getting good service because I’m a columnist, and this issue comes up surprisingly often. Whenever I write about a tech-support call that went well, or recount a run-in with an impressive clerk at Best Buy or whatever, there’s always an outpouring of feedback that amounts to: “You just got good service because you’re you.”

Well, I don’t know. Viewers of my videos might recognize me (it happens about once a month when I’m out and about); tech fans might know my name.
