clipper's remarks: Perhaps what’s likely to occur, writes the Chron, is a court-martial under Article 2 of the Uniform Code of Military Justice, to punish offenses allegedly committed by a man wearing a U.S. military uniform against other military personnel on a military base. The Army’s Criminal Investigation Division is responsible for recommending charges, prompting the military equivalent of a grand jury, known as an Article 32 hearing, where both prosecutors and defense can present evidence.

Those results would be reviewed by the base commander, who would decide whether to convene a court-martial. The 12-person jury would be composed of officers higher in rank than Hasan " lieutenant colonels and above.

The future indeed looks grim for Maj. Nidal Malik Hasan, the accused Fort Hood gunman, who last week opened fire in a processing center on the base, killing 13. Hasan was injured by gunfire, but remains alive and under heavy guard at Fort Sam Houston. That means, of course, Hasan will presumably be prosecuted for his actions.

But what will the legal proceedings look like for Hasan? The Houston Chronicle attempts to answer the question in a story out Monday.

A key question concerning Hasan’s fate hinges on whether civilian prosecutors conclude he was part of a terrorist plot that might justify moving his case into the federal criminal courts under U.S. anti-terrorism laws. If prosecutors, on the other hand, determine that Hasan acted alone, he could face the death penalty in a military court-martial.

Not a big well-thought-out plot centrally directed from a “safe haven” in South Asia and undertaken by brilliant covert operatives, but the desperate violent act of a clearly disturbed individual. It’s going to be very hard to prevent this sort of thing. As long as the United States remains a country in which firearms are widely available"for the foreseeable future, in other words"we’re going to be unusually vulnerable to mentally ill spree killers of various kinds, including spree killers who nod in the direction of Islamist thinking.

But the larger point is that while these incidents are serious crimes and major tragedies for the victims, they hardly rise to the level of a major macro-level social crisis. Imagine this. At a time of political turmoil, a charismatic, telegenic new leader arrives virtually out of nowhere. He offers a message of hope and reconciliation based on compromise and promises to marshal technology for a better future that will include universal health care.

The news media swoons in admiration -- one simpering anchorman even shouts at a reporter who asks a tough question: “Why don't you show some respect?!!” The public is likewise smitten, except for a few nut cases who circulate batty rumors on the Internet about the leader's origins and intentions. The leader, undismayed, offers assurances that are soothing, if also just a tiny bit condescending: “Embracing change is never easy.”

FBI: "No red flags" on Maj. Hasan

Maj Hasan was noticed by the FBI in December 2008

The FBI says that a US Army major suspected of killing 13 people was not part of a "broader terrorist plot".

Maj Nidal Hasan was noticed by the FBI in December as part of an unrelated inquiry by the Joint Terrorism Task Force, but did not raise concerns.

Investigators said his communications with another person were in line with his job as More.. an army psychiatrist.

The FBI said it had "no information to indicate that Maj Hasan had any co-conspirators or was part of a broader terrorist plot".

'No red flag'

"Because the content of the communications was explainable by his research and nothing else derogatory was found, the JTTF concluded that Major Hasan was not involved in terrorist activities or terrorist planning," the FBI said in a statement.

Content was of a social nature as well as "religious guidance".

They did not include the sort of threatening or inciting language that would have triggered an investigation

clipper's remarks: The Associated Press reported Sunday that Major Hasan attended the Falls Church mosque when Awlaki was there.

The Telegraph of London reported that Awlaki had made contact with two of the 9/11 hijackers when he was in San Diego.

He denied any knowledge of the hijacking plot and was never charged with any crime. After an intensive investigation by the FBI , Awlaki moved to Yemen.

People who knew or worked with Hasan say he seemed to have gradually become more radical in his disapproval of the war in Iraq and Afghanistan.

On Sunday, Sen. Joseph Lieberman (D-CT) called for an investigation into whether the Army missed signs as to whether Hasan was an Islamic extremist.

"If Hasan was showing signs, saying to people that he had become an Islamist extremist, the U.S. Army has to have a zero tolerance," Lieberman told Fox News Sunday.

A fellow Army doctor who studied with Hasan, Val Finell, told ABC News, "He would frequently say he was a Muslim first and an American . .

U.S. intelligence agencies were aware months ago that Army Major Nidal Malik Hasan was attempting to make contact with people associated with al Qaeda, two American officials briefed on classified material in the case told ABC News.

According to the officials, the Army was informed of Hasan's contact, but it is unclear what, if anything, the Army did in response.

Rep. Peter Hoekstra (R-MI), the ranking Republican on the House Intelligence Committee, said that he requested the CIA and other intelligence agencies brief the committee on what was known, if anything, about Hasan by the U.S. intelligence community, only to be refused.

Investigators want to know if Hasan maintained contact with a radical mosque leader from Virginia, Anwar al Awlaki, who now lives in Yemen and runs a web site that promotes jihad around the world against the U.S.

According to his site, Awlaki served as an imam in Denver, San Diego and Falls Church, Virginia.

More than the man, what we must remember is the plot itself.

I've read about them since but I don't recall how any of them impacted my life except for the fear. They would hide it from me, like a secret between them.

But I could feel it.

Very clearly, I can remember that sound.

It must have seemed so easy to them. They offered such a simple deal; give up control and we will restore order.

Overnight, my life, my entire world was erased.

It was done so quickly and violently, so completely, that it began to seem that it had never even existed.

There were those who understood what was happening, who knew it was wrong but who kept silent.

And in the vacuum of that silence, order was imposed.

Investigators also focused on Guns Galore, a firearms store just down the highway from the mosque. Store owner David Cheadle said federal agents interviewed him about the sale of a FN Herstal Five-Seven pistol that was used in the shootings. "It is a popular choice for personal defense," Cheadle said, pulling one from his case, "but it's expensive" -- more than $1,100 at his store.

The officials said a continuing search of Major Hasan’s computer indicates that he had logged on to Web sites that celebrated radical Islamic ideologies and that he had....

The gun, made of lightweight polymer, can handle magazines with 20 or 30 rounds. It is a controversial weapon among gun control advocates because it can penetrate body armor when used with more powerful, but restricted, ammunition employed by law enforcement and the military.

An Army official said the suspect had fired more than 100 rounds before he was felled by two Army civilian police officers, Sgt. Kimberly Munley and Sgt. Mark Todd.

While normal everyday oblivious Americans were preparing their beds to sleep Saturday night their elected officials quietly passed H.R. 3962, the Affordable Health Care for America Act. Indeed, the passage of this act deals one of the final death blows to the Constitution and with it our liberties.

As I ponder upon this momentously horrid occurrence it is as if I have just woken up from a nightmare and been thrown directly into the plot of George Orwell’s 1984, with no hope of escape. As this thought grabs hold I am lead to ponder more and more about America and I ask myself a few questions.

Truly, these questions are meaningless now. The Constitution is hanging by the tiniest of threads. Who will save it? Who will come to its rescue?

clipper's remarks: Constitutional attorney, bestselling author and hit radio show host Mark Levin certainly doesn't mince words. Alerted to Milbank's latest hit piece in The Washington Post, Levin called Milbank out as a propagandist of the first order.

The reason: out of literally tens of thousands of patriotic signs and shirts at Thursday's Capitol Hill protest, Milbank picked out a handful as supposedly representative of a crowd he described as "hateful and gruesome."

An outraged Levin called Milbank a "punk, a liar and a coward" while challenging him to a debate on his show.

Here's a Nazi reference that Milbank might appreciate: I think of him as the Josef Goebbels of his age. He writes patent propaganda in service of the State. And I can prove it.

In the front of the protest, a sign showed President Obama in white coat, his face painted to look like the Joker. The sign, visible to the lawmakers as they looked into the cameras, carried a plea to "Stop Obamunism." A few steps farther was the guy holding a sign announcing "Obama takes his orders from the Rothchilds" [sic], accusing Obama of being part of a Jewish plot to introduce the antichrist.

But the best of Bachmann's recruits were a few rows into the crowd, holding aloft a pair of 5-by-8-foot banners proclaiming "National Socialist Healthcare, Dachau, Germany, 1945." Both banners showed close-up photographs of Holocaust victims, many of them children....

Now, objecting to the health-care bill is one thing. But doesn't it send the wrong message for House Republicans to hold an event on the Capitol grounds full of hateful and gruesome words
