It is more than just a clock to the people of Edinburgh, it is a symbol of what we are. Free people who would rather die free than live in fear.

As some of you may or may not know, Edinburgh council are currently planning to move the Heart of Midlothian War Memorial from its home at Haymarket for the duration of the works on the new tram system. The council have also suggested that this move culminates in a new permanent site at Atholl Crescent, located off the main street and behind a row of protected trees - in other words, out of sight of the main thoroughfare.

It is much much more than just bricks and mortar and should continue to be sited in a prominent place at Haymarket, not tucked away out of view for the sake of a tram system which can quite easily accommodate a new site for the monument at Ryrie's Bar anyway. This was the council's original idea and was accepted during public consultation for the planning application - the council now wish to go back on what they promised us and remove the monument from Haymarket altogether.

That was spectacularly clueless, and one of the many occasions on which Obama has demonstrated that for all his fine degrees from Columbia and Harvard Law, he's ignorant of world history. First, no one at Nuremberg was permitted to file a habeas corpus petition in the American courts. Second, the Military Commissions Act provides substantially greater procedural and substantive protection than what any of the Nuremberg defendants had.

Rights for foreigners accused of being terrorists that even our own service personnel don't get. A "living, breathing" Constitution whose answers, are blowin' in the wind. You do get an indirect vote on whether that's what you want — but you have to cast it through your choices for POTUS/VPOTUS and (even less directly) U.S. Senators. Judicial appointments are just one more issue on which this year's presidential election presents you with a stark, vivid choice.

In a sentence: In June the SCOTUS said UCMJ-based provisions are inadequate; in July the SCOTUS proved that it has no clue what the UCMJ actually says.

That's why we've had an Attorney General and a Department of Justice since the founding of the Republic.

But both Barack Obama and Joe Biden are indeed lawyers, and Barack Obama frequently reminds us that he's even been a "professor of constitutional law" (which is a slight overstatement, but whatever). He immediately applauded the Boumediene decision:

Taking audience questions in Pennsylvania, Obama praised Thursday's Supreme Court decision to allow detainees at Guantanamo Bay to challenge their imprisonment in federal courts. Enforcing habeas corpus rights, he said, is "the essence of who we are."

"Even when Nazis' atrocities became known in the 1940s, he said, "we still gave them a day in court" at the Nuremberg trials. "That taught the entire world about who we are," he said.

The most senior judge in England and Wales has said that aspects of Islamic sharia law could be used in the UK, provided they don't conflict with existing laws. I say that Islamic sharia law should not be used in the United Kingdom and the Prime Minister should do everything within his power to stop it being introduced.

Any plan to clean up the mess on Wall Street must:

Ensure that middle income and working families are not the ones who are paying for this bailout by

Imposing a five-year, 10 percent surtax on income over $1 million a year for couples and over $500,000 for single taxpayers. That would raise more than $300 billion in revenue over five years;
Ensuring that assets purchased from banks are realistically discounted so companies are not rewarded for their risky behavior and taxpayers can recover the amount they paid for them; and
Requiring that taxpayers receive equity stakes in the bailed-out companies so that the taxpayers’ assumption of risk is rewarded when companies’ stock goes up.

Taken together these three provisions will substantially reduce the likelihood that this bailout will end up on the backs of average American taxpayers.

clipper's remarks: For the third week the community came out despite the heavy handed violent police presence last week. Children danced, people played music. One has to ask, why did all this have to happen in the first place? Why the riot gear and tear gas? The 15 min parking Lot Paranoia Law, makes it illegal to be in any downtown PUBLIC lot for any reason, for more than 15 min. It has only been used against the poor, activists and "undesirables" not breaking any constitutional laws. This week was a great victory!

Mesh fencing that circled the magnolia trees in Santa Cruz's Parking Lot #4 at noon on September 24th had been removed by 3:30pm and a painted cardboard banner hung proudly declaring, "Home of the Farmer's Market Drum Circle 10 Years Here!!" The drum circle seemed as large as ever with more people gathered in the parking lot. Wes returned, along with others in Santa Cruz Trash Orchestra, and Food Not Bombs provided another delicious vegan meal. At one point there were at least two police officers monitoring the drum circle, but unlike last week, they maintained a low profile while people enjoyed the special community gathering.

Help Kids Keep their Dads after Divorce

1. Custody and "parenting time" laws should balance and maximize the time children can have with each parent, presuming equal time with each parent.

2. Child Support laws should be reformed to ensure that fathers (and noncustodial mothers) are allowed to remain solvent. Support should at least temporarily adjust and abate for involuntary business failure, unemployment, disability, and military service. Support of children should be balanced between both parents and there should be accountability for the use of funds for the children.
