Justice Dept. Asked For News Site's Visitor Lists

In a case that raises questions about online journalism and privacy rights, the U.S. Department of Justice sent a formal request to an independent news site ordering it to provide details of all reader visits on a certain day.

The grand jury subpoena also required the Philadelphia-based Indymedia.us Web site "not to disclose the existence of this request" unless authorized by the Justice Department, a gag order that presents an unusual quandary for any news organization.

"I didn't think anything we were doing was worthy of any (federal) attention," Clair said in a telephone interview with CBSNews.com on Monday. After talking to other Indymedia volunteers, Clair ended up calling the Electronic Frontier Foundation in San Francisco, which represented her at no cost.

"Our fear is that this kind of bogus gag order is much more common than one would hope, considering they're legally baseless," Bankston says

IN a rapidly changing global media landscape, Clive Marshall has no doubt about one thing - the future of news agencies.

The outgoing chief executive of Australia's AAP, soon to head Britain's Press Association, says the news agencies of half a century ago would have relished today's opportunities.

"A news agency's customer base back then would have been the newspapers, plus a public broadcaster," Mr Marshall said in an interview.

"Now we have the internet, mobile phones, every conceivable device that takes content.

　監察院調查台南地檢署偵辦三一九槍擊案，認定檢方辦案欠缺直接證物，判定陳義雄是唯一凶手明顯不當，全案還有四項事證有疑慮，包括陳義雄是否自殺、犯案動機、一槍兩彈、和陳水扁褲子無血跡等，應該詳加調查。

　偵辦過程雖有疏失，不過昨日監察院司法及獄政委員會認為，此案已由特偵組接手，且有侵犯司法權之疑慮，最後決議只通過調查報告，送法務部轉最高檢察署，作為重啟調查的依據。

　曾任法務部次長的監委林鉅琅認為，監院從來沒有糾正過檢方的不起訴處分，基於五權分立的精神，應尊重檢方裁判。其他監委也認為，儘管基於督促司法行政，並不是沒有糾正的空間，但考量糾正可能遭致干預偵查權的質疑，委員會決定採取較為溫和的方式。

　特偵組則表示，監察院所提的各項疑點，都在特偵組的調查範圍內，等調查告一段落，會向外界說明。

　調查監委吳豐山指出，檢方認定陳義雄死因和死亡時間，與屍僵、屍斑狀態不符。檢方認定生前落水、落水時間四到六小時，但陳義雄屍體嚴重僵直還有屍斑，死亡超過十二小時，監委認為，此些疑點檢方沒交代清楚，還有屍體何以繫纏蚵繩、蚵團等事證，也未調查敘明，明顯不當。

　另外，檢方認定陳義雄行凶動機是不滿陳水扁，但刑事鑑定專家李昌鈺在接受監委約詢時表示，第一槍之彈道方向是瞄準呂秀蓮，刑事局的解釋卻是，「彈道朝呂秀蓮的方向，並不代表目標是呂秀蓮」，監委認為解釋不合理。

　至於南檢認定三一九案是一人一槍兩彈，但包括刑事局證物鑑定報告和李昌鈺的鑑定報告都無法確認兩顆子彈是從同一槍之所擊發，檢方卻認定只有一槍，明顯有問題。

　監委也認為，應該詳加調查的是陳水扁的內褲和西裝褲，為何沒有彈孔、也沒有血跡。儘管刑事局解釋陳水扁有鮪魚肚、當時又在揮手，所以褲子會掉下來，但監委認為，拿陳水扁公開行程的照片比對，穿西裝褲的習慣跟一般人沒有兩樣，照理褲子上緣應該在肚臍附近，對於外界的疑慮檢方都沒有釐清。

News Corp chairman Rupert Murdoch has suggested the company's online newspaper pages – including FoxNews.com, whose parent is News Corp. — will be invisible to Google users when it launches its new paid content strategy.

He claimed that readers who randomly reach a page via an Internet search hold little value to advertisers.

When asked by Sky News Australia's political editor David Speers why News Corp has not stopped Google from finding its content, Mr Murdoch replied: "I think we will."

I am not a defender of Fox News. Nor am I a defender of any other news outlet. No matter your news source, it seems you will find some bad or slanted reporting mixed in with good or objective analysis.

Google said on Tuesday, in response to threats by Rupert Murdoch to ban the search engine from listing content from his news empire, that any company could ask to have stories taken off.

In an interview in Australia, Murdoch accused Google of stealing stories from News Corp newspapers for the Google News service, and said he might ban them once he introduces charges for the papers' online editions.

Google said it was up to individual news organisations to decide whether they wanted their stories listed on Google News, and there were "simple technical standards" that would remove them if they wished.

"News organisations are in complete control over whether and how much of their content appears in search results," it said said in a statement issued in London.

"Publishers put their content on the web because they want it to be found, so very few choose not to include their material in Google News and web search. But if they tell us not to include it, we don't."
