Tenancy Disputes-Residential Letting Agreements

The tenancy tribunal plays an important role in the resolution of tenancy disputes.
The resolution of tenancy disputes in residential letting agreements is governed by Part 6 of the Residential Tenancies Act 2004. The dispute resolution committee of the PRTB replaces the courts.

The main areas of dispute
are

* deposit retention
* illegal evictions
* invalid notices of termination
* over-holding
* rent arrears
* breaches of obligations
* anti-social behaviour

A dispute may be referred for Mediation, Adjudication, Tribunal Hearing.
If the dispute is not resolved by mediation or adjudication then it will be referred to a Tenancy Tribunal. The PRTB can refer directly to a tribunal if it chooses.

If mediation takes place and is unsuccessful then it must be referred to a tribunal. A party to a determination can also appeal a decision of an adjudicator to a tenancy tribunal.

Tripoli, Libya (CNN) -- From within Libya's most secure jail a new challenge to al Qaeda is emerging.

Leaders of one of the world's most effective jihadist organizations, the Libyan Islamic Fighting Group (LIFG), have written a new "code" for jihad. The LIFG says it now views the armed struggle it waged against Col. Moammar Gadhafi's regime for two decades as illegal under Islamic law.

The code's most direct challenge to al Qaeda is this: "Jihad has ethics and morals because it is for God. That means it is forbidden to kill women, children, elderly people, priests, messengers, traders and the like. Betrayal is prohibited and it is vital to keep promises and treat prisoners of war in a good way. Standing by those ethics is what distinguishes Muslims' jihad from the wars of other nations."

In essence the new code for jihad is exactly what the West has been waiting for: a credible challenge from within jihadist ranks to al Qaeda's ideology.

On the night that Barack Obama won the 2008 presidential election, 21-year-old Mohammed el Gharani was sitting in a segregation cell in Guantanamo Bay's high security Echo Block.

He remembers the excitement among his fellow prisoners at the prospect of an Obama presidency. "Everyone was very hopeful; people were saying he was going to change things, that he would close the prison," Gharani, who was released in June, says.

"Even the guards were telling us that if he won, things would improve for us."

They were to be disappointed. A year after Obama's election win, Al Jazeera has learnt that despite the new president's pledge to close the prison and improve the conditions of detainees held by the US military, prisoners believe that their treatment has deteriorated on his watch.

Here are some of the details you need to know.

What the government will require you to do:

Sec. 202 (p. 91-92) of the bill requires you to enroll in a "qualified plan."

• Sec. 224 (p. 118) provides that 18 months after the bill becomes law, the Secretary of Health and Human Services will decide what a "qualified plan" covers and how much you'll be legally required to pay for it. That's like a banker telling you to sign the loan agreement now, then filling in the interest rate and repayment terms 18 months later.

Sec. 303 (pp. 167-168) makes it clear that, although the "qualified plan" is not yet designed, it will be of the "one size fits all" variety.

Sec. 59b (pp. 297-299) says that when you file your taxes, you must include proof that you are in a qualified plan.

Sec. 412 (p. 272) says that employers must provide a "qualified plan" for their employees and pay 72.5% of the cost, and a smaller share of family coverage, or incur an 8% payroll tax.

A long, long time ago, I was working for a fundraising firm. One of our biggest clients was NARAL -- then the National Abortion Rights Action League, now NARAL Pro-Choice America. One of my jobs was to identify and counter common objections to fundraising appeals and someone came to me with one that I thought was pretty much a gimme. People were objecting that, while they were supportive of a woman's right to choose, they were also sympathetic to complaints by anti-abortion types that they shouldn't have to their tax dollars paying for abortion. This just wouldn't be fair.

But, in Washington, never bet against the absurd. When the legislative sausage is made, a key ingredient is often a heaping scoop of stupid. Or, as was the case this weekend, Stupak.

The Anti-Counterfeiting Trade Agreement (ACTA) is an attempt to update international law to deal with online intellectual-property violations. The negotiations concluded on Friday and the next round are scheduled for Mexico in January.

One of the proposals, according to leaks, involve a three-strikes system: three infringements and your Internet service provider (ISP) has to yank the cord from the IP address, not just the lone user. A few illegal downloads, iPhone hackings or movie uploads and an entire family could be without Internet for 12 months.

The debate about U.S. immigration policy is a difficult and often emotional one. In recent years, a new component has been added. Shifting focus away from a debate based on the merits of various policy options, some of those advocating higher levels of immigration and amnesty for illegal aliens have resorted to attacking and impugning the motives of their opponents.

In the eyes of the law, there is no such thing as a “hate group.” It does not exist in federal statutes. It is a term entirely concocted by the SPLC. Moreover, the SPLC itself has no concrete definition. While lacking any useful specificity, the SPLC nonetheless deliberately uses this highly charged term to achieve political ends and to create an illusion that there is a surge of dangerous groups operating in America in order to increase the SPLC fundraising. In the process, the truth gets lost, reputations are damaged, and meaningful discourse on immigration policy is muted.

Researchers in Malaysian Borneo have captured the world’s most elusive and endangered cat on film. The beautiful Bornean bay cat, Catopuma badia, is so rare; a live cat was not even photographed until 1998!

Although the amazing video only lasts seven seconds, the chestnut-red cat with the long tail can be clearly seen walking through the forest. Because so little is known about this particular wild cat, even its eating habits are unknown.

Endemic to the forests of Borneo, threats to this elusive animal include illegal pet trade, poaching, deforestation and habitat loss largely due to palm oil plantations. Listed as Endangered on the IUCN Red List, it is estimated that only 2,500 Bornean bay cats remain in the wild today.

President Woodrow Wilson, who was concerned that dissent, in time of war, was a significant threat to morale. The passing of this act forbade Americans to use "disloyal, profane, scurrilous, or abusive language" about the United States government, flag, or armed forces during war. The act also allowed the Postmaster General to deny mail delivery to dissenters of government policy during wartime.

Freedom of speech in the United States is guaranteed by the First Amendment to the United States Constitution, which states in part: "Congress shall make no law... abridging the freedom of speech, or the press.

The Espionage Act made it a crime to help enemies of the United States, but the Sedition Act made it a crime to utter, print, write or publish any disloyal, profane, scurrilous, or abusive language about the United States' form of government.
