Canada passes ID theft laws

The Canadian Bankers Association has welcomed the introduction of "tough" new laws designed to combat identity theft.

The Canadian government re-introduced a bill in April after an initial attempt in 2007 failed to make it through committee debate.

The bill covers obtaining and possessing identity information, trafficking in ID data and holding or trafficking in government-issued identity documents.

後來，法院寄來判決書，「看了後，差點沒氣炸。」法官採信歹徒說詞，他們四人「同時撿到」郭麗安身分證，在「不知情下」拿撿來的身分證申辦手機門號，用新門號拚命打電話跟親朋好友聯絡。

郭麗安說，就算這些人同時撿到她的身分證，難道不知道使用別人身分證申請手機門號是錯誤行為？法官難道不知道使用撿來的身分證申辦手機門號是不對的事？法官竟然判這些人無罪，當庭釋放。

她還說出嫂嫂碰到的不愉快經驗，有一次嫂嫂在路上被搶皮包，報警說皮包裡有三萬元現金，還有一只約十萬元鑽戒，警察聽完，劈頭問：「為什麼帶那麼多錢？鑽石會貶值，妳的鑽戒哪有值那麼多錢？」

郭麗安說，警察一臉不高興，好像錯在被害人，不該帶上萬元在身上。

事後她才知道，如果民眾被搶超過一定金額，算重大刑案，警察背負破案壓力，因此怪她嫂嫂被搶太多。

冒用身分詐欺／女系主任賣淫？警局跑不完

警察大學副教授葉毓蘭痛批檢警處理身分被冒用的詐欺案太冷血，本報昨天報導後獲強烈迴響，很多人感同身受向葉毓蘭「報案」。她說：「法務部太怠惰，人權律師出身的王清峰部長應成立專責小組，正視類似問題。」

葉毓蘭表示，警政署也打電話給她，希望她協助解決類似問題，但她認為「檢察官問題更大、更嚴重」，檢察官的態度左右警方偵辦。

葉毓蘭的信箱昨天快被「報案」信件塞爆，某大學一名主管告訴她，一名女系主任數年前皮包被偷，報案後數個月，警方查獲她涉嫌「在酒店兼差賣淫」。這位漂亮的女系主任為證明沒做那些事，跑了好幾趟警局，尊嚴蕩然無存。女系主任的家屬都覺得太扯，為什麼警方不調查冒用身分證的女郎，卻堅持要被害人舉證「我沒做壞事」。

另有原子能委員會溫姓研究員在郵件中表示，兒子暑假打工，上網應徵司機，被騙走提款卡。當時兒子心想帳戶只有五十元無所謂，沒多久接到檢方傳票，成了被告，檢方要他兒子舉證自己沒犯罪。

溫姓研究員在信中說，他趕緊找律師與被害人和解，還錢後，檢察官認為「被告犯後態度良好」，聲請簡易判決。葉毓蘭說，「問題是，還是有罪，對年輕人是個汙點，難道檢察官不了解這類案件比比皆是？」

葉毓蘭說，許多詐欺案被告可能因為證件遺失，知識、能力不足被騙，把資料給了詐騙集團，沒有一點犯意，檢警卻用過去詐欺「幫助犯」的思維偵辦，被害人變被告。

葉毓蘭說，還有案子因主嫌未到案，一拖數年，使被害人帳戶被列為警示帳戶，沒人願僱用，工作權都受侵犯。

她表示，檢警開口、閉口要被害人舉證自己沒犯罪，檢察官未善盡法律上查明責任，反讓首腦逍遙法外享受犯罪所得。

「法官和警察如果沒辦法分辨好人與壞人，那一定是專業訓練出了問題。」國立彰化師大副校長郭麗安說，她的身分證遺失後，被四名歹徒冒用申辦手機，法官竟採信四名歹徒「同時撿到身分證」的說詞，判決四名歹徒無罪。

「這份判決書，我到現在還放在抽屜裡，告訴自己，以後遇到不公平的事不要生氣。」

想起七年前的事她仍忿忿難平，她說，遺失皮包後立刻報警，數個月後，多張手機通話費帳單陸續寄來，她向每家電信業者說明不是她申辦手機。幸而警察協助她逐一解決帳單，並一舉逮捕四名冒用她身分證申辦手機門號的歹徒。

Hacker pleads guilty to ID thefts netting millions

A 28-year-old Miami man who made millions breaking into computer networks and stealing credit card numbers pleaded guilty on Friday and agreed to forfeit more than $2.7 million in restitution, as well as a condo, jewelry, and a car.

Albert Gonzalez, a former federal government informant and the alleged ringleader of one of the largest known identity theft cases in U.S. history, pleaded guilty (as expected) to 19 counts of conspiracy, computer fraud, wire fraud, access device fraud, and aggravated identity theft related to theft of credit and debit card data from TJX Companies (owner of T.J. Maxx), BJ's Wholesale Club, OfficeMax, Boston Market, Barnes & Noble, Sports Authority, among other retailers.

"Secure Flight," Insecure Travel Rights

Starting this year, Americans will have to get government approval to travel by air. As Privacy Journal revealed last fall, henceforth "Permission Now Needed to Travel Within U.S." Getting a reservation and checking-in for air travel will soon require Transportation Security Administration authorization. That permission is by no means assured: For example, if your name matches a "no-fly" list, even mistakenly, you can be denied the right to a reserve a seat on a flight. If your name is on a "selectee" list, you and your possessions will be searched more thoroughly before you can board. What is going on here?

PASS ID Act is REAL ID 2.0

On June 15, 2009, S. 1261, the "Providing for Additional Security in States' Identification Act of 2009" or the "Pass ID Act" was introduced in the Senate. If the bill becomes law, it would establish a national ID card. Its provisions are similar to those contained in the controversial REAL ID Act. REAL ID has faced ongoing criticisms from state governments, technical experts, and privacy advocates. The REAL ID implementation posed a number of privacy threats because of document collection, retention, sharing, and use.

The PASS ID Act states that, beginning one year after the final regulations are issued, no federal agency can accept a driver's license or state-issued ID card unless the issuing state is "materially compliant."

The PASS ID Act gives the Secretary of Homeland Security "unreviewable discretion" to issue driver's licenses and state ID cards
