California doctors lose gay discrimination case

LOS ANGELES (AFP) — Doctors in California may not discriminate against gay patients on the basis of their religious beliefs, the state's supreme court ruled on Monday.

The California Supreme Court decision overturned a lower court ruling in favor of two Christian doctors who refused fertility treatment to a lesbian citing religious grounds.

The woman, Guadalupe Benitez, successfully filed suit against the doctors and their medical group in 2004 on the basis that their refusal to treat her violated California's anti-discrimination laws.

However an appeal court in San Diego ruled against Benitez, a decision that led to the supreme court ruling.

In an unanimous decision the justices ruled that Benitez was entitled to be treated like other patients with the same condition, and that constitutional protections for religious liberty do not excuse unlawful discrimination.

California doctors who have religious objections to gays and lesbians must nevertheless treat them the same as any other patient or find a colleague in the office who will do so, the state Supreme Court ruled unanimously Monday.

The justices rejected a San Diego County fertility clinic's attempt to use its physicians' religious beliefs as a justification for their refusal to provide artificial insemination for a lesbian couple. The ruling, based on a state law prohibiting businesses from discriminating against customers because of their sexual orientation, comes three months after the court struck down California's ban on same-sex marriage.

"This isn't just a win for me personally and for other lesbian women," said the plaintiff, Guadalupe Benitez. "Anyone could be the next target if doctors are allowed to pick and choose their patients based on religious views about other groups of people."

The California Supreme Court today ruled unanimously that doctors cannot cite their religious beliefs as grounds to deny gay and lesbian patients medical care.

Justice Joyce Kennard ruled that two Christian fertility doctors who refused to artificially inseminate a lesbian couple cannot claim a free speech or religious exemption from California's anti-discrimination law.

The ruling extends a state law barring sexual orientation-based discrimination to the medical profession.

In 1999, after a year of surgeries and hormone treatments — all covered by insurance — Benitez was finally ready to get pregnant. But at the crucial moment, her doctor refused to do the procedure for "religious" reasons.

Benitez is a lesbian and sued her doctors under California's civil rights laws, charging that they discriminated against her because of her sexual orientation.

DeGeneres and De Rossi wed in LA

US talk show host Ellen DeGeneres has married her long-time partner, actress Portia de Rossi, according to the Associated Press news agency.

The presenter, 50, and De Rossi, 35, exchanged handwritten vows in a private ceremony attended by 19 guests, reported People and US magazine.

'Ecstatic'

"They were hugging and kissing, and looked ecstatic," a witness told the magazine.

Both DeGeneres' mother and De Rossi's mother, who flew in from Australia, attended the ceremony.

DeGeneres made broadcast history in 1997 when her TV alter ego came out of the closet on her self-titled sitcom Ellen, becoming the first openly gay lead character on US prime-time network television.

The presenter came out herself in the same year, and was in a relationship with actress Anne Heche until 2000.

MI5, the UK security service, is looking to recruit more gay staff - following many investment banks and private sector employers - in a move that reflects dramatic changes in the attitudes of the British establishment over the last decade.

Stonewall, the gay lobby group, has been hired to advise MI5, the domestic arm of the intelligence services, on how to encourage its spies to be more open about their sexuality and how to attract more gay applicants for posts.

The contract marks a significant change in stance by MI5. Gay men and women were barred from working in sensitive posts in the diplomatic or security services until the early 1990s, a quarter of a century after sexual acts between men were decriminalised in 1967. The ostensible rationale was concern that gay spies could be vulnerable to blackmail, while gay ambassadors could exacerbate tensions between the UK and countries that still criminalise homosexuality.

The Secret Court of 1920 was a secret tribunal convened in 1920 at Harvard University to rid the university of homosexuals.

Headed by then president Abbott Lawrence Lowell, the tribunal included acting Dean Chester N. Greenough, Assistant Dean Edward R. Gay, Professor of Hygiene Robert I. Lee, and Regent Matthew Luce. The "Court" met in secret, and held secret interrogations of students and one assistant professor suspected of being homosexual. Fourteen men were found "guilty": eight students, one Assistant Professor and PhD candidate, one recent graduate, and four men not associated with the university. All the students who were found guilty were expelled from the university, in most cases permanently.

No matter what one thinks of the merits of the Obama flip-flop, for him to cite his work with John McCain on Senate reform as the best example of his willingness to work against party and self-interest is more than just oily. It is deeply deceptive.

As was Obama's response to Warren's question on marriage.

"I am not somebody who promotes same sex marriage, but I do believe in civil unions," Obama flatly stated.

In a letter read to a gathering of the Alice B. Toklas LGBT Democratic Club on Sunday, Democratic Presidential Candidate Barack Obama reaffirmed his opposition to ballot measures that propose to take away the freedom to marry for lesbian and gay couples, including California's Proposition 8.

Obama lacked the courage to acknowledge his position on Proposition 8 and its centrality to the campaign for same sex marriage not just in California but across the United States.

Partly they adhere to these archaic beliefs because it gives them biblical authority to feel superior (if they are straight) and backs up their notion of persecution when others speak out against their homophobia.

Christians should speak out freely against homosexuality

Speaking out against same-sex unions can result in a variety of consequences for anyone who dares to do so in the workplace, consequences which can include being required to attend special re-education workshops on “diversity” that teach that people must put values or religious beliefs aside to observe a “higher” value of tolerance.

So conservatives find themselves in a very precarious position regarding the issue of same-sex relationships. The issue is no longer just a political or a social issue; it’s a very personal one.

How do we tell them what we believe the Bible has to say about homosexuality? The same Bible that lumps homosexuality in with a variety of other sins is the same Bible that provides the answer to that question.

As Christians, we have an obligation to others, and that is to be mirrors, mirrors that reflect Christ’s love and also his truth.

Andrea Camperio Ciani and colleagues at the University of Padua, Italy, showed that the female relatives of homosexual men tend to have more children, suggesting that genes on the X chromosome are responsible. Now the team have shown that the same is true for bisexuality.
