The most commonly litigated aspect of employment law is instances involving the termination of the employment contract itself.

Although disputes are not uncommon in the workplace, most will be resolved without the parties involved being compelled to terminate the employment contract.

However in some instances this may be the only reasonable avenue available to either or both parties.

Contracts of employment may be terminated in a number ways including: agreement, dismissal, repudiation and frustration.

Recovery hopes rise on surprise unemployment figures

British unemployment is rising at a far slower rate than expected, official figures revealed today.

The number of people out of work increased by 30,000 to 2.46 million in the three months to September while the number of people in work rose for the first time in more than a year.

The jobless rate is 7.8 per cent, confounding expectations for an increase to 8 per cent.

The number of people in work rose by 6,000 in the three months to September, the first increase since the three months to July 2008.

The figures will raise hopes that the worst of the recession has passed and that unemployment will peak at a lower level than the three million previously feared.

The Office for National Statistics said that people claiming benefits rose by 12,900, far below a forecast 20,000 rise.

Like many people, Gina Uberti wanted to take time off from work for a religious holiday.

Unlike most Connecticut workers, her religion is Wicca, the largest of the neo-pagan, earth-based faiths. Wiccans worship multiple deities, use magic in their rituals, adhere to a basic code of morality, and hold four major seasonally based festivals.

Uberti attended one of those festivals last October. A dispute with a supervisor over that vacation has led to an unusual federal lawsuit.

Jarad M. Lucan, who practices employment law at Durant, Nichols, Houston, Hodgson, & Cortese-Costa in Bridgeport, is not involved with the case. But he said it should send a message to employers that, no matter how common or obscure the religion, if a worker sincerely believes it to be their religion, then employers must reasonably accommodate them under the federal Civil Rights Act of 1964.

Westboro Baptist Church, a hate group that travels around the country holding anti-gay rallies, protested outside the school attended by President Obama's children on Monday morning.

The "church," run by Fred Phelps and composed largely of his extensive family, is known for staging its events for maximum publicity and controversy. In the past, members have demonstrated outside troops' funerals. Recently they have been targeting Jewish temples. Now they're aiming their vitriol at Washington-area schools -- including Sidwell Friends, where Malia and Sasha Obama are students.

A message on Westboro's website refers to the Obama children as "satanic spawn" of a "murderous bastard." Along with various schools, the church is also protesting outside the White House, the World War II memorial, and the Equal Employment Opportunity Commission field office.

Protesters were carrying signs with anti-gay, anti-abortion and anti-Obama slogans, slowing down traffic all along Wisconsin Avenue.

In The Long Emergency (2005, Atlantic Monthly Press), I said that we ought to expect the federal government to become increasingly impotent and ineffectual - that this would be a hallmark of the times. In fact, I said that any enterprise organized at the colossal scale would function poorly in years ahead, whether it was a government, a state university, a national chain retail company, or a giant midwestern farm. It is characteristic of the compressive contraction our society faces that giant hypercomplex systems will wobble and fail. We should expect this.

It's tragic that the avatar of hopefulness himself, Barack Obama, stepped into his role at exactly the moment when this set of conditions was getting traction. It is sure to get worse, and there are going to be a lot of disappointed people out there

who will be suffering terrible losses and real pain in daily life.

Washington and the Jobs Market

If Democrats really want to create jobs and save themselves from a debacle in 2010, their best policy option is to stop creating so much investment uncertainty and additional barriers to business hiring.

Stop trying to raise business costs by making it easier to unionize via "card check." Stop trying to raise energy costs with a cap-and-tax bill. Stop adding to the deficit and future tax burden with a 12% increase in domestic spending for 2010.

Above all, stop trying to ram through Congress on a partisan vote a health-care bill that imposes a 5.4-percentage-point income tax "surcharge" on anyone making more than $500,000 a year......

A familiar definition of insanity is to keep doing the same thing and expecting different results. So in the wake of yesterday's report that the national jobless rate climbed to 10.2% in October, we suppose we can expect the political class to demand another "stimulus." Maybe if Congress spends another $787 billion in the name of job creation, it can get the jobless rate up to 12% or 13%.

It's hard to imagine a more complete repudiation of Keynesian stimulus than the evidence of the last year's job market. We've now had two examples of such stimulus—President Bush's $160 billion effort in February 2008 and President Obama's mega-version a year later—and neither has made even the smallest dent in employment. As the nearby chart shows, Mr. Obama's economic advisers sold the stimulus by saying it would keep the jobless rate below 8%. Actual results may differ, as they say.

The economy shed another 190,000 jobs in October, taking the total job losses to 3.5 million since January.

Juveniles face jail for carrying spray paint

Children in New South Wales could be imprisoned for up to six months if they are caught carrying cans of spray paint without a legitimate reason.

The new measures are part of a crackdown on graffiti.

The State Government will make it an offence for juveniles to carry spray paint without an excuse, such as school work or employment.

The act will be punishable by fines of up to $1,100 or six months in jail.

It is the first time the courts will have the power to imprison minors for the act of possessing spray cans alone.

Premier Nathan Rees is also planning to announce an annual graffiti clean-up day, where community members will volunteer their time to help chemically remove paint.

Graffiti artist James McCallum says the Government is taking an uninformed approach that might have a lot of unintended consequences.

"Especially when you're talking about getting tough on in this case, kids who are disenfranchised, who are actually in doing graffiti, engaging with their community," he said.
