NYQUIL DEFENSE FOR DUI CASES:

How much Nyquil would one need to start showing impairment. A regular size bottle of Nyquil (6 oz) contains 10% ETOH. This means that; 10%/100 X 6 fl. Oz. = the amount of ETOH in the whole bottle. Therefore there is only .6 fl. Oz. Of ETOH. The formula for determining a person's theoretical BAC is:

Volume X % = oz. Of ETOH X .05 X (150/ person's body weight) = BAC

Here are some examples computed by Officer Tony Corroto - Atlanta P.D. - DRE Instructor.

If he weighs 150 lbs his theoretical BAC for drinking the entire bottle would be .03%.

If he weighs 180 lbs. His theoretical BAC for drinking the entire bottle would be .025%.

250 lbs & drinking the entire bottle = .018%

The formulas are common math formulas which Officer Corroto obtained from Breath Test Operator's class from the Indiana State Department of Toxicology, Indiana University.

Transformers and Indiana Jones star Shia LaBeouf was injured in a car crash Sunday morning and arrested on suspicion of drunken driving. Per the AP, LaBeouf was trying to make a left turn at a West Hollywood intersection around 3 am when his pickup truck crashed into another vehicle. The actor's truck rolled over, causing injuries to his head, left hand and knee. (LaBeouf's female passenger and the operator of the other vehicle were not seriously injured.)

LaBeouf's other brushes with the law include a February citation for smoking in a no-smoking zone in Burbank, and an arrest for misdemeanor trespassing late last year following a drunken argument with guards at a Walgreens. Both charges were later dropped or dismissed. — Adam Bryant

Shia LaBeouf arrested for drink driving

SAN FRANCISCO (Reuters) - "Indiana Jones" star Shia LaBeouf was arrested on suspicion of drink driving after an auto accident in which he was injured early Sunday, a police official said on Sunday.

LaBeouf was driving a vehicle that collided with another vehicle at 3 a.m. in Hollywood, Los Angeles County Sheriff's Sgt. Scott Wolf said.

"He subsequently injured his head, knee and hand and was hospitalized," Wolf said.

Wolf said LaBeouf was booked for misdemeanour DUI (driving under the influence) and then released.

LaBeouf's passenger and the driver of the other vehicle sustained minor injuries, Wolf said, adding that he did not know their identities.

The accident occurred when LaBeouf made a left turn in front of the other vehicle, causing a collision in which his car rolled over, Wolf said.

LaBeouf, a protege of director Steven Spielberg, starred in this summer's box office hit "Indiana Jones and the Kingdom of the Crystal Skull."

Rhode Island man's .491 blood alcohol level sets state record

A North Providence man who crashed into a road sign late Monday was tested as having a blood-alcohol level six times the legal limit – believed to be the highest reading on a Breathalyzer in Rhode Island, according to the state police

Stanley Kobierowski, 34, was tested after he crashed into an electronic message board on Route 95 near Providence Place. He tested at the scene with a blood-alcohol level of .489 and then .491. Kobierowski was released on personal recognizance after a bail hearing and will face another hearing Friday on charges of drunken driving and resisting arrest

The legal limit in Rhode Island is 0.08. A level of 0.30 is classified as stupor, 0.4 is comatose and 0.5 is considered fatal, according to the health department

Kobierowski was released on $1,000 personal recognizance pending a District Court hearing on Friday

The defendant argued that the State should not be allowed to introduce evidence from the Intoxilyzer if the defense was not allowed to examine how the Breathalyzer worked.
