The internet chapter of the Anti-Counterfeiting Trade Agreement, a secret copyright treaty whose text Obama's administration refused to disclose due to "national security" concerns, has leaked. It's bad. It says:

* * That ISPs have to cut off the Internet access of accused copyright infringers or face liability. This means that your entire family could be denied to the internet -- and hence to civic participation, health information, education, communications, and their means of earning a living -- if one member is accused of copyright infringement, without access to a trial or counsel.

* * That the whole world must adopt US-style "notice-and-takedown" rules that require ISPs to remove any material that is accused -- again, without evidence or trial -- of infringing copyright. This has proved a disaster in the US and other countries, where it provides an easy means of censoring material, just by accusing it of infringing copyright.

And the emergent danger to personal liberty that I see, the threat of our time? The fundamental imbalance between the individual and the corporation. Corporate power distorts our lives, from DRM and the struggle over net neutrality, through the health insurance/employment trap and all the way to the power of lobbyists and the ownership of news media. What ordinary individual would have the resources to pursue a grievance against a large company? Who could hold his patent or his impolitic truth against one determined to pursue him³?

The two ways to address this imbalance are to limit corporate power and to strengthen the individual. And the tool to use in both of these efforts is government; nothing else has the standing or power to do it. Enforcing antitrust laws, strengthening union protections, and yes, reforming health insurance would all create real improvements in individual liberty.

"DRM is dead, isn't it?," said Jonathan Lamy, chief spokesperson for the RIAA, when asked about the RIAA's view on DRM for an upcoming SCMagazine article.

Lamy's comment was in reference to the DRM-less iTunes store and other online services offering unrestricted music. And while the rest of us have known this for awhile, this is the first time that the RIAA has said on record that DRM is dead. Let's hope it stays that way.

The Ministry of Truth would have truly appreciated DRM and tethered devices. As many owners of Kindle e-books discovered this morning, electronic books that come rigged with DRM "copy protection," stored on e-book readers subject to Amazon remote control, can be made to disappear at the whims of their publishers, as if they never existed in the first place.

David Pogue reports today in the New York Times that books published by MobileReference, including Orwell's Nineteen Eighty-Four and Animal Farm, were remotely deleted from customers' Kindles over night.

This is Amazon choosing its "content partners" over its customers. There is nothing about copyright law that required these deletions -- if Amazon didn't have the rights to sell the e-books in the first place, the infringement happened when the books were sold. Remote deletion doesn't change that, and it's not an infringement for the Kindle owner simply to read the book.

Amazon began remotely deleting books from Kindles this morning. Illegal books? Nope. Perfectly legal versions of George Orwell’s “1984″ and “Animal Farm”, purchased through Amazon.

Why? Well, apparently the publisher changed their minds about having digital versions of the books available for the Kindle, reports David Pogue. Okay, that’s up to them — from this point forward. But those who already paid for the books, own them. In a word, this is bullshit.

Seriously, why doesn’t Amazon just come into our houses and burn the print copies as well while they’re at it?

Update: As commenter Edward Virtually notes, this action is likely within Amazon’s legal rights. I think that’s pretty obvious or there is no way they would have done it. But that doesn’t mean it’s not complete and utter bullshit too. Everyone who hears about this and has a Kindle will now think twice about buying a book on there. Legal BS aside, this is Amazon shooting themselves in the foot here. Big time.
