On Monday, the Supreme Court will explore what type of inventions would require a patent in a pivotal case that can undermine a legal protection for software. This patent rule will bar processes and methods in doing businesses. Among those are online shopping techniques, medical diagnostic tests, procedures for executing trades on Wall Street and even undercut patents on software formulation and manufacture. The bad side of this ruling might affect high-tech industries as it can invalidate many existing software patents or at it maybe difficult for them to defend their case in lawsuits. It can also hard to apply for patents since softwares are generally patented as a process for doing something than as a physical invention.

Loud lovemaking called nuisance; recording played in court

(Newser) – A judge in England has upheld the conviction of a woman whose loud noises during sex "constituted a statutory nuisance," the BBC reports. Caroline Cartwright appealed an earlier decision, saying she had a right to "respect for her private and family life," but the court disagreed. And so did her neighbors. "The noise sounds like they are both in considerable pain," one said. "I have never ever heard anything like it."

Neighbors complained of losing sleep, saying the screaming and shouting occurred "virtually every night," and "for hours at a time." Complainants were joined by passers-by during the day, including a postman and a woman walking her kid to school. And if that wasn't mortifying enough, a recording of the couple having sex was played in court.

clipper's remarks: Perhaps what’s likely to occur, writes the Chron, is a court-martial under Article 2 of the Uniform Code of Military Justice, to punish offenses allegedly committed by a man wearing a U.S. military uniform against other military personnel on a military base. The Army’s Criminal Investigation Division is responsible for recommending charges, prompting the military equivalent of a grand jury, known as an Article 32 hearing, where both prosecutors and defense can present evidence.

Those results would be reviewed by the base commander, who would decide whether to convene a court-martial. The 12-person jury would be composed of officers higher in rank than Hasan " lieutenant colonels and above.

The future indeed looks grim for Maj. Nidal Malik Hasan, the accused Fort Hood gunman, who last week opened fire in a processing center on the base, killing 13. Hasan was injured by gunfire, but remains alive and under heavy guard at Fort Sam Houston. That means, of course, Hasan will presumably be prosecuted for his actions.

But what will the legal proceedings look like for Hasan? The Houston Chronicle attempts to answer the question in a story out Monday.

A key question concerning Hasan’s fate hinges on whether civilian prosecutors conclude he was part of a terrorist plot that might justify moving his case into the federal criminal courts under U.S. anti-terrorism laws. If prosecutors, on the other hand, determine that Hasan acted alone, he could face the death penalty in a military court-martial.

LONDON — The questions before the judges in Courtroom No. 1 of Britain’s Supreme Court were as ancient and as complex as Judaism itself.

Who is a Jew? And who gets to decide?

David Lightman with his daughter, who was denied admission to the Jews' Free School because her mother's conversion was not recognized. But a court ruling has voided the admissions policy.

The case began when a 12-year-old boy, an observant Jew whose father is Jewish and whose mother is a Jewish convert, applied to the school, JFS. Founded in 1732 as the Jews’ Free School, it is a centerpiece of North London’s Jewish community. It has around 1,900 students, but it gets far more applicants than it accepts.

Because M’s mother converted in a progressive, not an Orthodox, synagogue, the school said, she was not a Jew — nor was her son. It turned down his application.

A corrupt former Philadelphia cop who used his badge to rob drug dealers was sentenced yesterday to 30 years in a federal lockup.

In a letter read to the court before sentencing, Police Commissioner Charles H. Ramsey said that Malik Snell's criminal acts had so tarnished the badge that he wore for 12 years that it would be removed from service and destroyed.

Dems Rejected 11 Amendments Requiring Congress to Enroll in Gov’t-Run Health Plan

More than 200 amendments were rejected by the House Rules Committee ahead of Saturday's vote on the Democrats' health care bill, including 11 that would have required members of Congress and other government officials to be enrolled in the same federal insurance plan proposed for the American people.

Critics of the health care bill said they offered the 11 amendments – including some that would require the president, vice president, and Supreme Court justices to give up their Federal Employees Health Benefit Program (FEHBP) to enroll in the ‘public option’ or Medicaid – to showcase the problems with the massive legislation.

“If Congress forces our constituents into a public option plan over time, then members of Congress should be expected to do the same,” Rep. Howard McKeon (R-Calif.)

A Sydney man accused of sending harassing letters to families of dead soldiers has chained himself to a railing outside a court and is holding an Australian flag above his head.

Earlier today Man Monis, 45, who also uses the name Sheik Haron, faced Downing Centre Local Court charged with seven counts of using a postal service to harass.

Monis, wearing long flowing robes and a white turban, has been chained to the railing outside the court for almost six hours.

He is holding an Australian flag in one hand and a sign calling for Australian troops to be brought home from Afghanistan.

Monis says he is prepared to stay chained to the railing all night.

The 45-year-old was arrested by counter-terrorism police at his Croydon Park home in Sydney's inner-west last month.

Police say he sent letters to the families of Australian soldiers killed in Afghanistan, accusing some of the soldiers of being criminals and murderers.

Is life without parole cruel and unusual punishment for juvenile offenders convicted of non-homicide crimes?

Marc Mauer of the Sentencing Project and Kent Scheidegger of the Criminal Justice Legal Foundation are debating this question today on Room for Debate.

This morning, the Supreme Court hears arguments on the cases of Terrance Graham and Joe Sullivan, two prisoners in Florida who were sentenced to life without possibility of parole for crimes they committed as minors. In 2005, the court ruled that the Eighth Amendment’s ban on “cruel and unusual punishment” prohibited the execution of juvenile offenders. Does sentencing a teenager to die in prison for crimes in which no one was killed also violate the Eighth Amendment?

RICHMOND, Va. (AP) - The U.S. Supreme Court has refused to block Tuesday's scheduled execution of sniper mastermind John Allen Muhammad.

The Court did not comment Monday on why it refused to consider his appeal.

Muhammad is scheduled to die by injection at 9 p.m. tomorrow in the state death chamber at the Greensville Correctional Center for the slaying of Dean Harold Meyers at a gas station during a three-week spree in October 2002 across Maryland, Virginia and Washington, D.C.

Muhammad and his teenage accomplice, Lee Boyd Malvo, were also suspected of fatal shootings in other states, including Louisiana, Alabama and Arizona. Malvo is serving a life sentence in prison.

Muhammad still has a clemency petition before Virginia Gov. Timothy M. Kaine.

President Barack Obama instructed Justice Department attorneys to argue last week in San Francisco before Federal District Judge Vaughn Walker, that he must toss out the Electronic Frontier Foundation's Shubert v. Bush lawsuit challenging the secret state's driftnet surveillance of Americans' electronic communications.

In a Court filing late Friday night, the Obama Administration attempted to dress up in new clothes its embrace of one of the worst Bush Administration positions--that courts cannot be allowed to review the National Security Agency's massive, well-documented program of warrantless surveillance. In doing so it demonstrated that it will not willingly set limits on its own power and reinforced the need for Congress to step in and reform the so-called 'state secrets' privilege.
