A federal appeals court reviewing evidence at Guantanamo Bay compared a Bush administration legal argument to one made by a hapless, dimwitted character in a 19th century nonsense poem by Lewis Carroll.

The U.S. Court of Appeals for the District of Columbia Circuit cited the 1876 poem, "The Hunting of the Snark," in ruling that the military improperly labeled a Chinese Muslim as an enemy combatant. The ruling was issued last week but an unclassified version of the opinion was released only Monday.

The government insists that the statements made in the documents are reliable because the State and Defense Departments would not have put them in intelligence documents were that not the case," the court wrote.

The judges compared the argument to the logic in Carroll's nonsense poem, in which a hapless crew hunts for a creature that is never quite defined. The Bellman, the ship's leader, led his men across the ocean, guided by a map that was just a blank piece of paper.

French Military Demonstration Turns Tragic When Soldier Fires Into Crowd With Live Ammo Instead Of Blanks

A soldier using live ammunition instead of blanks wounded 16 people at a demonstration of hostage-rescue techniques in France on Sunday, officials said.

The Defense Ministry said investigators will look into why real bullets were used during the demonstration at the Laperrine military barracks in southeast France.

Agence France-Presse reported that the soldier fired the live rounds into a crowd of hundreds of people who had gathered for the demonstration.

A witness to the shooting told AFP that "suddenly, people were falling, we thought it was part of the exercise, and then we saw blood."

An Honor That Bush Is Unlikely to Embrace

SAN FRANCISCO — Reagan has his highways. Lincoln has his memorial. Washington has the capital (and a state, too). But President Bush may soon be the sole president to have a memorial named after him that you can contribute to from the bathroom.

From the Department of Damned-With-Faint-Praise, a group going by the regal-sounding name of the Presidential Memorial Commission of San Francisco is planning to ask voters here to change the name of a prize-winning water treatment plant on the shoreline to the George W. Bush Sewage Plant.

The plan, naturally hatched in a bar, would place a vote on the November ballot to provide “an appropriate honor for a truly unique president.”

Supporters say that they have plenty of signatures to qualify the initiative and that the renaming would fit in a long and proud American tradition of poking political figures in the eye.

WASHINGTON — Justice Department officials illegally used "political or ideological" factors in elite recruiting programs in recent years, tapping law-school graduates with conservative credentials over more qualified candidates with liberal-sounding résumés, an internal report found Tuesday.

The report, prepared by the Justice Department's own inspector general and its ethics office, tells how senior department screeners weeded out candidates for career positions whom they considered "leftists," using Internet search engines to look for incriminating information or evidence of possible liberal bias.

One rejected candidate from Harvard Law School worked for Planned Parenthood. Another wrote opinion pieces critical of the USA Patriot Act and the nomination of Samuel Alito Jr. to the Supreme Court.

George Carlin, irreverent comedian, dies at 71

George Carlin, the Grammy-Award winning standup comedian and actor who was hailed for his irreverent social commentary, poignant observations of the absurdities of everyday life and language, and groundbreaking routines like "Seven Words You Can Never Use on Television," died in Los Angeles on Sunday, according to his publicist, Jeff Abraham. He was 71.

This guy is just wrong to teach on so many levels.

Teacher accused of burning cross on student's arm

(CNN) -- School administrators in Ohio voted Friday to begin the process of firing a middle school teacher accused of burning a cross into a student's arm and refusing to keep his religious beliefs out of the classroom.

Freshwater was also reprimanded several times for refusing to move his Bible from his classroom desk and teaching creationism alongside evolution, according to the 15-page independent report. The report also cites evidence that Mr. Freshwater told his students that "science is wrong because the Bible states that homosexuality is a sin and so anyone who is gay chooses to be gay and is therefore a sinner."

Youthful bullet dealer charged with Pentagon fraud

MIAMI (Reuters) - A 22-year-old Miami Beach man who managed to get a $298 million Pentagon contract to supply ammunition despite having no experience in the arms trade was charged with trying to defraud the U.S. government, U.S. officials said on Friday.

Efraim Diveroli's company AEY Inc. was suspended from federal work in March after the U.S. Army found out that ammunition it was contracted to supply the Afghan army consisted of Chinese gun cartridges that were more than 40 years old.

The Associated Press filed six Digital Millenium Copyright Act takedown requests against the Drudge Retort claiming that the users linking to its stories are violating its copyright and committing "'hot news' misappropriation under New York state law.

Many bloggers and citizen journalists will write articles, then use small quotes from the original source, where the original words need to be in context and exact so as to not misquote or misrepresent the story itself.

This has started a whirlwind in the blogosphere and the media with prominent and lesser known bloggers determining to simply not use any AP articles, but instead use Reuters, Agence-France-Press, McClatchy or IPS to stop driving any traffic whatsoever to any AP articles. They even set up a petition to start implementing their boycott against the AP.

The Associated Press to Set Guidelines for Using Its Articles in Blogs

The Associated Press, one of the nation’s largest news organizations, said that it will, for the first time, attempt to define clear standards as to how much of its articles and broadcasts bloggers and Web sites can excerpt without infringing on The A.P.’s copyright.

Last week, The A.P. took an unusually strict position against quotation of its work, sending a letter to the Drudge Retort asking it to remove seven items that contained quotations from A.P. articles ranging from 39 to 79 words.

On Saturday, The A.P. retreated. Jim Kennedy, vice president and strategy director of The A.P., said in an interview that the news organization had decided that its letter to the Drudge Retort was “heavy-handed” and that The A.P. was going to rethink its policies toward bloggers.

The quick about-face came, he said, because a number of well-known bloggers started criticizing its policy

John McCain said Friday that the Supreme Court ruling on Guantanamo Bay detainees is “one of the worst decisions in the history of this country.”

The presumptive GOP nominee said the decision, a 5-4 ruling Thursday that determined Guantanamo detainees have the right to seek release in civilian courts, would lead to a wave of frivolous challenges.

“We are now going to have the courts flooded with so-called … habeas corpus suits against the government, whether it be about the diet, whether it be about the reading material. And we are going to be bollixed up in a way that is terribly unfortunate because we need to go ahead and adjudicate these cases,” he said at a town hall meeting in New Jersey.

Barack Obama released a statement Thursday saying the Supreme Court decision “ensures that we can protect our nation and bring terrorists to justice while also protecting our core values.”

Court’s decision is a rejection of the Bush administration’s attempt to create a legal black hole at Guantanamo

Each object left behind becomes more significant than it has ever been, hinting at the life prior to its disuse. Floors collapse and walls cave in without care; if you get hurt, no one is here to help you.

This site, started in 2002, is basically an account of the various abandonments I have explored and the photographs I have taken.

Yes, many of the places on here are not named to protect their integrity, and to prevent this web site from becoming a "shopping list" of places to explore or vandalize.
