GOP Reps. Smith, Sensenbrenner, Coble, Gallegly, Goodlatte, Chabot, and Cannon after much deliberation put the Constitution and rule of law before politics. Rep. Lamar Smith stated, “As much as one might wish to avoid this process, we must resist the temptation to close our eyes and pass by. The president's actions must be evaluated for one simple reason: the truth counts.”

We should not underestimate the gravity of the case against the president. When he put his hand on the Bible and recited his oath of office, he swore to faithfully uphold the laws of the United States - not some laws, all laws.

Stop the new FISA

Allowing the new surveillance law to stand would seriously cripple our free press.

If the sweeping surveillance law signed by President Bush on Thursday -- giving the U.S. government nearly unchecked authority to eavesdrop on the phone calls and e-mails of innocent Americans -- is allowed to stand, we will have eroded one of the most important bulwarks to a free press and an open society.

The new FISA Amendments Act nearly eviscerates oversight of government surveillance. It allows the Foreign Intelligence Surveillance Court to review only general procedures for spying rather than individual warrants. The court will not be told specifics about who will be wiretapped, which means the law provides woefully inadequate safeguards to protect innocent people whose communications are caught up in the government's dragnet surveillance program.

This morning, Sen. Sheldon Whitehouse (D-RI) delivered an impassioned floor speech to help frame the debate over FISA reform. Using his privilege as a member of the Senate Intelligence Committee, Whitehouse said he has “spent hours poring over” secret opinions issued by the Department of Justice’s Office of Legal Counsel (OLC) — and he took notes.

1. An executive order cannot limit a President. There is no constitutional requirement for a President to issue a new executive order whenever he wishes to depart from the terms of a previous executive order. Rather than violate an executive order, the President has instead modified or waived it.

2. The President, exercising his constitutional authority under Article II, can determine whether an action is a lawful exercise of the President’s authority under Article II.

3. The Department of Justice is bound by the President’s legal determinations.
