SCO never owned UNIX copyrights, owes Novell 95 percent of UNIX royalties

Federal district judge Dale A. Kimball issued a ruling on Friday declaring that Novell owns the UNIX copyrights. Kimball's ruling means that the end is near for SCO's protracted litigation trainwreck, an epic assortment of lawsuits that have achieved infamy in the tech industry. Judge Kimball finds that Novell never transferred ownership of the UNIX copyrights to SCO during or after a 1995 agreement between the two companies.

Judge Kimball has ruled that SCO owes Novell 95 percent of the royalties generated by the licensing of Novell's UNIX copyrights.

According to Judge Kimball's ruling, Microsoft paid SCO approximately $16 million for license rights and Sun paid approximately $10 million. SCO neglected to turn over the licensing fees to Novell, which "gave SCO its first profitable year in history,"

Few options remain open for SCO, and a bankruptcy could be imminent.

NEW YORK: Johnson & Johnson, the health-products giant that uses a red cross as its trademark, sued the American Red Cross on Wednesday, demanding that the charity halt the use of the red cross symbol on products it sells to the public.

Johnson & Johnson said it has had exclusive rights to use the trademark on certain commercial products — including bandages and first-aid cream — for more than 100 years.

It contends that the Red Cross is supposed to use the symbol only in connection with nonprofit relief services.

The suit, filed in U.S. District Court in New York, marked the breakdown of months of behind-the-scenes negotiations and prompted an angry response from the Red Cross.

"After more than a century of strong cooperation in the use of the Red Cross trademark. ... we were very disappointed to find that the American Red Cross started a campaign to license the trademark to several businesses for commercial purposes," Johnson & Johnson said in a statement.

When New Mexico Governor Gary Johnson announced on CBS’s 60 Minutes that he had used marijuana and cocaine in his younger days and – gasp! – liked it, a cacophonous uproar ensued. Elected and appointed officials from both major parties knocked each other over in the rush to denounce the governor for this unpopular and dangerous stance and vowed to oppose any decriminalization or legalization schemes.

Of course, Johnson waited until after he was reelected to drop this bombshell on the public, but who could blame him? Politicians, even a maverick like Johnson, live for the next election. If he had publicized his controversial views before the election, Marty Chavez would now be the governor of New Mexico instead of settling for his old job as the mayor of Albuquerque.

Freeganism is a lifestyle choice

They eat food they find in bins and are driven by conscience, not financial need. Meet the freegans.

There's no such thing as a free lunch, so the saying goes, but freegans beg to differ.

They only eat food they can scavenge for free from supermarket dustbins. Most is only just past its sell-by date, some is still within it but the packaging has been damaged.

The freegan philosophy of "ethical eating" is a reaction against a wasteful society and a way of highlighting how supermarkets dump tonnes of food every year that is still edible.

Boycott

They argue capitalism and mass production exploit workers, animals and the environment. For the most extreme proponents, freeganism - the name combines free and vegan - is a total boycott of the economic system.

Freegans Paul and Bob operate in a suburb of Manchester and have a network of bins that provided rich pickings.

Eight-million-year-old bug is alive and growing

An 8-million-year-old bacterium that was extracted from the oldest known ice on Earth is now growing in a laboratory, claim researchers.

If confirmed, this means ancient bacteria and viruses will come back to life as ice melts due to global warming. This is nothing to worry about, say experts, because the process has been going on for billions of years and the bugs are unlikely to cause human disease.

If true, however, Falkowski's findings could considerably extend the record for the oldest DNA frozen in ice. Last month, a team of researchers led by Eske Willerslev of the University of Copenhagen in Denmark announced that they had recovered DNA from the Greenland ice sheet that was up to 800,000 years old (see Oldest frozen DNA reveals a greener Greenland).

ABOUT 80% of married men face erectile dysfunction five years into their marriage because of having a single sex partner, China Press reported yesterday.

It quoted Singapore's Dr Yu Wei Siang, who is otherwise known as Doctor Love, as saying that 50% of men faced the problem with their sex partner after being married for between three and five years and 80% of them after being married for five years.

The paper said it was normal for a married couple to experience low libido after having the same partner for a long period of time.

Dr Yu was invited by the Johor Baru Tionghua Federation to speak in Johor Baru about sex on Sunday.

Most members of the audience preferred to ask questions via SMS.

He advised married couples to take the trouble to look for new environment and stimulation.

Infants shown such educational series end up with poorer vocabularies, study finds. Researcher says 'American Idol' is better.

Parents hoping to raise baby Einsteins by using infant educational videos are actually creating baby Homer Simpsons, according to a new study released today.

For every hour a day that babies 8 to 16 months old were shown such popular series as "Brainy Baby" or "Baby Einstein," they knew six to eight fewer words than other children, the study found.

Parents aiming to put their babies on the fast track, even if they are still working on walking, each year buy hundreds of millions of dollars' worth of the videos.

Christakis said children whose parents read to them or told them stories had larger vocabularies.

"I would rather babies watch 'American Idol' than these videos," Christakis said, explaining that there is at least a chance their parents would watch with them — which does have developmental benefits.

Spammer gets 30 years in the slammer

Notorious spammer Christopher "Rizler" Smith was sentenced to 30 years in prison by a federal judge on Wednesday.

US District Judge Michael Davis called Smith a "drug kingpin" before throwing the book at him. Smith was convicted on charges of conspiracy, illegal distribution of drugs, money laundering and operating a continuing criminal enterprise.

The Minneapolis Star Tribune reports that the judge was somewhat hesitant about the length of the prison term recommended by sentencing guidelines, but in the end, decided it was reasonable.

Smith hasn't exactly been a darling to the court system. In addition to fleeing justice abroad, he didn't exactly make pals with the prosecution by issuing a death threat to the children of a witness in the case.

Linux: Google to Join in Protecting it from Patent Challenge

The Open Invention Network members share their Linux patents with each other and offer the prospect of a joint defense if Linux is confronted with a legal challenge.

Google is following IBM and Oracle in circling the wagons around open source Linux. The company is expected to announce Tuesday that it has become a member of the Open Invention Network, a group that pools Linux patents as a means of turning back any patent infringement challenge to Linux.

The addition of Google means seven companies have formed a bulwark of protection around Linux.

"This is a way for everyone to get together and look after Linux development," said Chris DiBona, open source programs manager for Google in an interview. Every user of the Google search engine is being supported by Linux, and Google manages its internal Web indexing and analysis of Web pages with systems running on clusters of Linux servers. "Linux is very important to Google," DiBona said.

Walking does more than driving to cause global warming, a leading environmentalist has calculated.

Food production is now so energy-intensive that more carbon is emitted providing a person with enough calories to walk to the shops than a car would emit over the same distance. The climate could benefit if people avoided exercise, ate less and became couch potatoes. Provided, of course, they remembered to switch off the TV rather than leaving it on standby.

The sums were done by Chris Goodall, campaigning author of How to Live a Low-Carbon Life, based on the greenhouse gases created by intensive beef production. “Driving a typical UK car for 3 miles [4.8km] adds about 0.9 kg [2lb] of CO2 to the atmosphere,” he said, a calculation based on the Government’s official fuel emission figures. “If you walked instead, it would use about 180 calories. You’d need about 100g of beef to replace those calories, resulting in 3.6kg of emissions, or four times as much as driving.

Inspector general finds lax computer security by IRS employees

WASHINGTON – IRS employees ignored security rules and turned over sensitive computer information to a caller posing as a technical support person, according to a government study.

Sixty-one of the 102 people who got the test calls, including managers and a contractor, complied with a request that the employee provide his or her user name and temporarily change his or her password to one the caller suggested, according to the Treasury Inspector General for Tax Administration, an office that does oversight of Internal Revenue Service.

The caller asked for assistance to correct a computer problem.

Only eight of the 102 employees contacted either the inspector general's office or IRS security offices to validate the legitimacy of the caller.
