Georgia claimed today to have downed two Russian warplanes over its territory after the former Soviet neighbours came into direct conflict over the breakaway province of South Ossetia.

Tbilisi mobilised its army reserves and launched a major military offensive overnight to regain control over the province, raising fears of an all-out war that could draw in Russia.

Moscow backs the separatists, most of whom are Russian citizens, and has its own "peackeepers" in South Ossetia.

Fighting raged around the city of Tskhinvali, the South Ossetian capital, as Georgian troops backed by tanks and warplanes pounded separatist forces today. At least 15 people were reported to have been killed although the death toll was expected to rise.

The dean of Massachusetts School of Law at Andover is planning a September conference to map out war crimes prosecutions, and the targets are President Bush and other administration officials.

The dean, Lawrence Velvel, says in a statement that “plans will be laid and necessary organizational structures set up, to pursue the guilty as long as necessary and, if need be, to the ends of the Earth."

Other possible defendants, he said, include federal judges and John Yoo, the former Justice Department official who wrote one of the so-called torture memos.

“We must insist on appropriate punishments,” he continued, “including, if guilt is found, the hangings visited upon top German and Japanese war criminals in the 1940s."

Velvel elaborates in an introduction to a series of articles published in The Long Term View (PDF). He writes “there is no question” that Bush and other officials are guilty of the federal crime of conspiracy to commit torture.

On April 24, the Washington Post’s Dana Milbank reported on the Pentagon’s effort to keep media out of earshot and photo range of the funeral of Lt. Col. Billy Hall, the 4,011th American to die in Iraq. Milbank wrote that Gina Gray, Arlington’s new director of public affairs, “pushed vigorously to allow the journalists more access to the service yesterday — but she was apparently shot down by other cemetery officials.”

Today, Milbank reports that Gray was demoted and then fired by the Army for trying to investigate the restrictions on the media:

Gray told Milbank that Arlington’s deputy superintendent “has been calling the families of the dead to encourage them not to allow media coverage at the funerals — a charge confirmed by a high-ranking official at Arlington, who spoke on the condition of anonymity.”

Last month, CBS’s Lara Logan said she believed “the soldiers feel forgotten” because Americans don’t understand the harshness of the Iraq war.

Paul Wolfowitz, in his first public remarks on the Iraq war in years, said the American government was "pretty much clueless on counterinsurgency" in the first year of the war.

The former deputy secretary of defense said yesterday that the force sent to Iraq was adequate for fighting Saddam Hussein's military, citing the speed with which American troops toppled the regime. But Mr. Wolfowitz said no one in the Bush administration anticipated that Saddam would order his security services to wage an insurgency after their formal defeat on the battlefield.

his remarks yesterday have special relevance, because in the run-up to the war, the deputy secretary of defense downplayed testimony from a retired Army chief of staff, General Eric Shinseki, who told Congress that postwar stabilization operations would require several hundred thousand troops.

On February 27, 2003, Mr. Wolfowitz told the Senate Armed Services Committee that the estimate was "wildly off the mark."

Cheney told Raddatz that American war policy should not be affected by the views of the people. But that is precisely whose views should matter: It is the people who should decide whether the nation shall go to war. That is not a radical, or liberal, or unpatriotic idea. It is the very heart of America's constitutional system.

In Europe, before America's founding, there were rulers and their subjects. The Founders decided that in the United States there would be not subjects but citizens. Rulers tell their subjects what to do, but citizens tell their government what to do.

If Dick Cheney believes, as he obviously does, that the war in Iraq is vital to American interests, it is his job, and that of President Bush, to make the case with sufficient proof to win the necessary public support.

When the vice president dismisses public opposition to war with a simple "So?" he violates the single most important element in the American system of government: Here, the people rule.

Rattling Swords In South America - Columbia Raids Ecuador

TENSIONS between Colombia, Ecuador and Venezuela reached a new high after Bogota launched a cross-border raid into Ecuador, killing the second-ranking official of Colombia's largest leftist rebel group.

Raul Reyes of the Revolutionary Armed Forces of Colombia (FARC) was killed Saturday in an air raid conducted by Colombian forces on a jungle camp located on the Ecuadoran side of the common border.

In response, Ecuadoran President Rafael Correa recalled his country's ambassador to Bogota "for consultations" and warned the action might result in "ultimate consequences" because of "the offense" suffered by his country.

Meanwhile in Caracas, Venezuelan President Hugo Chavez warned Colombia not to carry out raids against the FARC on Venezuelan territory, saying it could spark a war.

"President Uribe, think about it long and hard. You had better not get the idea of doing this on our territory because it would be a 'causus belli', cause for a war," President Chavez said
